RESPA Rule Proposed by HUDThe Department of Housing and Urban Development (HUD) published revised proposed RESPA (Real Estate Settlement Procedures Act) rules in the March 14, 2008, issue of the Federal Register to "improve the process of obtaining mortgages and reduce consumer costs." The 95-page document creates a standard GFE, applies cost tolerances, and requires settlement agents to draft, read, and provide a "closing script" to consumers. Public comments are due May 13, 2008. In addition, HUD has also published a nearly 600-page "Regulatory Impact Analysis and Initial Regulatory Flexibility Analysis": http://www.hud.gov/offices/hsg/sfh/res/200803/5180RIA.pdf The American Land Title Association (ALTA) has issued a one-page response to the proposed RESPA rule: http://www.alta.org/images/PDF/08-03-14_RESPA_press.pdf. The ALTA Title Insurance Marketing Kit is now available on ALTA's website. North Carolina Department of Insurance approves title insurance premium for insured closing protection This action is consistent with the provisions of the Model Title Insurance Act which was sponsored by the National Association of Insurance Commissioners and provides for a charge for insured closing protection. That group recognized closing protection as a significant risk category for which the insurer must be compensated. Please note that the charge for closing protection is a premium and subject to the regulation of the Department of Insurance including sanctions for intentional deviation from filed rates.
